Health Canada Cosmetics Registration Regulations Changes (Effective October 9)

The Government of Canada has announced changes to the Cosmetics Notification Form in accordance with the Cosmetics Ingredient Disclosure Regulations . These changes will take effect on October 9, 2024 and are aimed at enhancing consumer safety and clarity. Key changes include:


Major changes:


  1. Section 2 – Products:

    • New field: “Product Type” to specify whether the cosmetic is a rinse-off product or a leave-on product.

    • Area of Application: You must indicate the body area on which the product will be used.


  2. Section 3 – Reporter:

    • The reporting party may be the manufacturer, importer or agent, and all relevant notifications will be sent to the reporting party.


  3. Section 4 – Manufacturing and Labeling Contact:

    • This section is changed to Manufacturing and Label Contact and you will need to add your manufacturer and label contact information.

    • A Canadian address is required to complete your submission, but this requirement will be implemented in the future.


  4. Section 5 – Product Ingredients:

    • [INCI (International Nomenclature of Cosmetic Ingredients)] is mandatory, and if the ingredient is not available, the chemical name must be listed.

    • A new field has been added to allow you to enter exact ingredient concentrations , and concentration ranges have been revised to reflect the revised regulations.

    • If a restricted ingredient is included, the product's label text must be submitted.


  5. Section 8 – Submissions:

    • A declaration field has been added, declaring that the information submitted is accurate, current, and complete.

    • The Signature field has been added as required, and the signature must match the contact name in the Reporter section.

 

Of particular note in the upcoming Canadian Cosmetics Regulations are the revisions to Section 4 – Manufacturing and Labeling Contact . Under the previous regulations, foreign manufacturers could register by simply listing their foreign address and contact information on the label, but the revised regulations require that a Canadian address and contact information be included.


Due to this change, if you do not have a Canadian address at the product level, you may need to completely replace your labels or add a Canadian address when registering after October 9. To avoid this hassle, it is safest to complete your registration before October 9 .


The exact date of implementation will be announced at a later date, but we recommend that you prepare in advance to ensure smooth business operations.

 

Specific changes to Section 4 are as follows:


Section 4 – Manufacturing and Labeling Contact:


  • Section Name Change: This section will be renamed from its previous name to “Manufacturing and Labeling Contact.”


  • Manufacturer Information: Reporters must provide contact information for the manufacturer , including:

    1. Canadian Manufacturer: A manufacturer who manufactures cosmetics in Canada and sells them under their own trademark, design, trade name, or other name they own or control.

    2. Responsible person acting on behalf of a foreign manufacturer: If the manufacturer is located outside of Canada, the responsible person acting in Canada on behalf of that manufacturer .

    3. Importer or Third-Party Manufacturer: If there is no person in Canada who meets the definition of a manufacturer, the importer or third-party manufacturer is considered the manufacturer.


  • Label Contact: You must provide consumer contact information (telephone number, email, website address, postal address, etc.) on your product label so that consumers can ask questions about your product.


  • Add multiple manufacturers and agents: You can add multiple manufacturers, importers, and third-party agents as needed to act on your behalf.


  • Canadian Address Required: The report can only be successfully filed if it includes a Canadian address . This requirement will be implemented in the future, and the specific implementation date has not been determined. Additional notice will be provided before it takes effect.
